Contractual partners within the framework of the present general terms and conditions are you (hereinafter "buyer") and Ciausoiu Vinothek, Schweighofstrasse 398, 8055, Zurich, Switzerland (hereinafter "seller").

These general terms and conditions (GTC) apply to the processing of all orders from private customers with the seller. The seller's offer at www.cvinothek.ch is aimed exclusively at private customers and expressly not at commercial customers.
The version of the general terms and conditions valid at the time of the order applies exclusively.
The seller's offer is limited to the territory of Switzerland.
All prices (unless otherwise noted) are per item and in Swiss francs, exclusive of VAT.
Price changes and time-limited promotions are possible at any time and do not require notification.
Items that are not eligible for a discount and are permanently excluded from tasting and price campaigns are identified as such or marked as exceptions.
When ordering online, payment is made either by debiting the credit card specified during the ordering process (Eurocard/MasterCard, Visa, American Express), Postfinance for Switzerland (Postfinance Card, Postfinance E-Finance), PayPal, prepayment or by invoice.
When paying by invoice, payment must be made within 20 days of the order date. The date of the payment order is decisive for meeting the deadline.
If you pick up the wine at a wine shop, you have to pay when you pick it up.
It is at the discretion of the seller to decide which payment methods are permitted.
The offer on www.cvinothek.ch is subject to change and is only valid while stocks last. The contract between the buyer and the seller is only concluded when the seller expressly confirms the buyer's order (Art. 7 Para. 2 OR).
The assortment (products, vintages, etc.) of the seller is subject to constant change. We reserve the right to make short-term changes to the range and/or vintage. A complete and constant availability of the offer on www.cvinothek.ch can therefore not be guaranteed.
In the case of wines and spirits with limited availability or items where demand exceeds supply, the seller will endeavor to distribute the goods as fairly and non-speculatively as possible throughout Switzerland, whereby the specifications of the producers (product mix) must also be met. Limited availability of wines and spirits are excluded from the free tasting and from all promotions and discounts.
The seller's logistics partners deliver the ordered goods to the buyer's desired address. The proportion of shipping costs to be borne by the buyer is always CHF 18.00 per delivery. From an order value of more than 120 CHF, the shipping costs are not borne by the buyer. In this case, shipping costs 0 are automatically displayed in the shopping cart. Furthermore, there are no shipping costs for certain products or campaigns. This can be found on the product pages and is also displayed to the buyer in the shopping cart.
For deliveries in Switzerland (including the Principality of Lichtenstein), the buyer can optionally specify a desired day for delivery (except Saturday and Sunday) at no additional cost.
The buyer has the right to revoke his request (order) at any time without giving reasons.
In order to exercise your right of withdrawal, you must inform us of your decision to withdraw from this contract by means of a clear statement (e.g. a letter sent by post, fax or e-mail). You can use the model cancellation form (6.1.) for this, but this is not mandatory. The declaration must show the buyer's unequivocal will to revoke his application (order).

If the goods have already been delivered to the buyer, they will be picked up again by the seller's logistics partners at the seller's expense, namely at the buyer's original delivery address.
If the cancellation is valid and the returned goods are intact, the seller will reimburse the buyer for the purchase price already paid, including the share of delivery costs paid by the buyer for the original delivery. However, the delivery cost share will not be refunded if the buyer has chosen a different delivery method for the original delivery instead of the standard delivery offered by the seller. Repayment is usually made within fourteen days of receipt of the declaration of revocation by the seller and in the form of the means of payment used by the buyer.
The buyer is liable to the seller for the professional storage of the goods (in particular no incidence of light, constant storage temperature, regulated humidity) and bears their costs until the seller collects the goods from the buyer again.
A cancellation by the buyer is not possible when ordering perishable goods or at a point in time less than six months before the expiry date of the goods (wine is not considered a perishable goods. This exception only applies if you order other products (e.g. olive oil , tomato sauce, etc.) which can spoil quickly).
For the subscription, the right of withdrawal applies to the first package. If the purchase contract for the first of four packages is concluded without exercising the right of withdrawal, the customer has agreed to the subscription with at least 4 packages.

All wines can be reliably stored under good storage conditions (no incidence of light, constant storage temperature, controlled humidity) up to the date specified on the cellar card.
If, contrary to expectations, the buyer does not like the taste of a wine, they can either receive a replacement product (while stocks last), a credit to their customer account or the full purchase price, upon presentation of the proof of purchase. This also applies to any wine faults.
Further or other warranty claims of the buyer do not exist; in particular, there is no right to compensation for consequential damage.
According to legislation, the sale of alcohol to young people is subject to various restrictions. The seller generally does not sell alcohol to young people under the age of 18. By stating his birthday, the buyer bindingly states his age so that this regulation and the statutory provisions can be complied with.

Any liability in connection with our offer (in particular incorrect illustrations, texts and prices) and the delivery is excluded to the extent permitted by law.
The seller expressly reserves the right to adapt these general terms and conditions to the circumstances at any time and to apply them immediately.
In the event of disputes, Swiss law is exclusively applicable. The place of jurisdiction is the ordinary courts at the seller's registered office.
